These Terms and Conditions (“Terms”) govern your access to and use of the websites, landing pages, lead magnets, downloads, emails, videos, membership areas, community spaces, programs, products, services, and related content offered by Videospot Online, Inc. d/b/a Beat Cancer with Me (“Beat Cancer with Me,” “BCWM,” “Company,” “we,” “us,” or “our”), including without limitation https://beatcancerwithme.com, https://www.go.beatcancerwithme.com/, and any related pages, funnels, social channels, or digital properties (collectively, the “Site”).

By accessing or using the Site, downloading any resource, opting in to receive emails, purchasing any product or service, or participating in any BCWM community or membership, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use this Site, purchase our products or services, or participate in our membership community. By using the Site, you represent that you meet these requirements.

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

3. Educational Purpose Only — No Medical Advice

BCWM provides educational and informational content related to cancer support, health, wellness, nutrition, fasting, lifestyle, community, personal experience, and related topics.

We are not your physician or medical provider. Nothing on this Site, in our guides, emails, videos, community, membership calls, resources, AI tools, or other materials is medical advice and nothing is intended to diagnose, treat, cure, or prevent any disease.

You should always consult your licensed physician or other qualified healthcare professional before making decisions regarding diet, fasting, supplements, labs, medications, treatment, exercise, or any other health-related matter. Do not disregard professional medical advice or delay seeking it because of something you saw on our Site or in our community.

4. No Provider-Patient Relationship

Your use of the Site, downloads, emails, membership, community, comments, chat areas, or live calls does not create a physician-patient, practitioner-patient, therapist-client, dietitian-patient, fiduciary, or other professional relationship between you and BCWM, Videospot Online, Inc., or any guest expert, contributor, moderator, or community member.

5. No Guarantees; Individual Results Vary

Any information shared through BCWM is based on education, experience, opinion, and in some cases personal stories or guest contributions. Results vary from person to person.

We do not guarantee any particular health outcome, symptom improvement, lab result, diagnosis, remission, recovery, weight change, or other result from using our Site, resources, community, products, or services.

Testimonials, case studies, and member stories reflect individual experiences and are not guarantees of future or typical results. FTC guidance also requires testimonials and endorsements to be truthful and not misleading, which is why this language matters for BCWM.

6. Personal Responsibility and Assumption of Risk

You acknowledge that your use of the Site and any actions you take based on information from BCWM are voluntary and solely at your own risk.

Health-related practices such as changing diet, beginning fasting, using supplements, or altering lifestyle habits can involve risks, especially for people with cancer, chronic illness, diabetes, medication use, pregnancy, or other medical conditions. You accept full responsibility for your choices, actions, and results.

7. Accounts and Registration

Some features of the Site or community may require registration. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly of any unauthorized use of your account.

We may suspend or terminate any account if we believe you violated these Terms or engaged in conduct that is unlawful, unsafe, disruptive, deceptive, abusive, or otherwise harmful to the community or to us.

8. Membership Community Rules

If you participate in any BCWM membership, forum, private group, call, comment section, or other interactive space, you agree not to:

• harass, threaten, abuse, defame, or intimidate others;

• post false, deceptive, or misleading content;

• present yourself as a licensed medical professional if you are not;

• give individualized medical instructions or emergency advice to other members;

• upload viruses, malware, or harmful code;

• spam, solicit, advertise, or self-promote without permission;

• infringe another person’s privacy, intellectual property, or legal rights;

• share another member’s personal or health information without consent.

We reserve the right, but not the obligation, to moderate, edit, remove, restrict, or retain content and to suspend or terminate accounts or memberships in our sole discretion.

9. User Content

If you submit or post comments, questions, testimonials, photos, videos, reviews, or other content (“User Content”), you represent that you own it or have the right to share it.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, distribute, and adapt that User Content for operating, improving, and promoting BCWM, subject to our Privacy Policy and any separate written permissions you and we may agree on.

You retain ownership of your User Content.

10. Honest Reviews and Testimonials

Nothing in these Terms is intended to prohibit or restrict your right to leave honest reviews or share honest opinions about BCWM. However, you agree that any review, testimonial, or submission you provide will be truthful and based on your actual experience.

We may edit testimonials for length, grammar, or clarity, but we will not knowingly publish fake or misleading testimonials. FTC rules that took effect on October 21, 2024 specifically target deceptive consumer reviews and testimonials.

11. Intellectual Property

All content on the Site, including text, videos, audio, graphics, logos, PDFs, downloads, guides, community materials, branding, and compilations, is owned by or licensed to BCWM/Videospot Online, Inc. and is protected by copyright, trademark, and other intellectual property laws.

You may access and use the Site and its materials for your own personal, non-commercial use only. You may not copy, reproduce, republish, upload, post, distribute, transmit, sell, license, scrape, frame, modify, create derivative works from, or otherwise exploit any content without our prior written permission.

12. Lead Magnets and Downloads

Any free or paid ebook, guide, checklist, PDF, replay, workbook, email series, or other download we provide — including the Vegan Keto Guide — is licensed to you for your personal, non-commercial use only.

You may not resell, redistribute, upload elsewhere, share access to, or present these materials as your own without our prior written permission.

13. Product Recommendations, Affiliate Links, and Third-Party Services

We may recommend or link to third-party products, supplements, devices, foods, books, labs, practitioners, software, tools, or services. Some of those links may be affiliate links or may otherwise provide us with compensation or other benefits if you click or purchase.

Any such material connection should be clearly disclosed in accordance with FTC endorsement guidance.

We do not manufacture or control third-party products or services and do not guarantee their safety, effectiveness, quality, availability, or suitability for your situation. Your use of any third-party offering is solely between you and that third party.

14. Purchases, Payments, and Online Commerce

If you purchase any product, membership, subscription, or service through the Site, you agree to provide current, complete, and accurate billing information.

Payments may be processed by third-party payment processors. We are not responsible for errors, outages, breaches, or acts or omissions of third-party processors, platforms, or merchants.

We reserve the right to refuse, limit, or cancel any order for any lawful reason, including suspected fraud, pricing errors, platform issues, or misuse of our offers.

15. Email and SMS Communications

If you opt in to receive emails from us, we may send you educational content, newsletters, updates, reminders, promotional messages, membership information, and other communications related to BCWM. You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us at info@thevideospot.net

The Beat Cancer with Me SMS Program sends opted-in users educational content, reminders, membership updates, promotional messages, and service-related notifications. 

You must be 18 years of age or older to use this SMS service. 

To stop receiving SMS messages, text STOP to the number or shortcode from which you received the message. We will send a one-time confirmation of your opt-out. After that, you will no longer receive SMS messages unless you opt in again. To rejoin, sign up again through the original opt-in method.

SMS opt-in consent and mobile numbers collected for SMS purposes are not shared with third parties or affiliates for marketing or promotional purposes. This information may be shared only with vendors and providers needed to deliver SMS services.

By opting in, you agree to receive SMS messages from Beat Cancer with Me / Videospot Online, Inc. in compliance with applicable law, carrier requirements, and industry standards.

16. Memberships, Recurring Billing, and Cancellation

If you enroll in the Beat Cancer with Me Circle or any other recurring membership or subscription, you authorize us and our payment processor to charge your payment method on a recurring basis according to the terms presented at checkout.

Your subscription will continue until canceled. You may cancel future renewals at any time before your next billing date by filling our our cancelation form in the membership portal.

Unless otherwise stated at checkout, cancellation stops future billing only and does not create a retroactive refund for charges already processed.

Because Utah’s Automatic Renewal Contracts Act became effective January 1, 2025, businesses offering many auto-renewing paid terms longer than 45 days must provide specified renewal notices, and trial offers generally require notice at least 3 days before the trial ends. Renewal notices generally must go out 30 to 60 days before renewal and clearly disclose the renewal date, renewal cost, and cancellation instructions. Your checkout and email flows should match that.

17. Refund Policy

Each BCWM product, membership, event, call, or service may have its own specific refund policy, which will be stated on the applicable checkout page, order form, or sales page.

If no refund policy is stated for a particular offer, that offer is non-refundable to the fullest extent permitted by law.

18. Prohibited Uses

You may not use the Site:

• for unlawful, fraudulent, harmful, or abusive purposes;

• to violate any law or regulation;

• to interfere with the security or operation of the Site;

• to scrape, automate, reverse engineer, or gain unauthorized access to the Site or related systems;

• to upload malicious code;

• to impersonate another person or misrepresent your qualifications;

• to post content that is defamatory, obscene, hateful, threatening, invasive of privacy, or otherwise objectionable.

We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that any content will be accurate, complete, reliable, or suitable for your needs.

21. Limitation of Liability

To the fullest extent permitted by law, BCWM, Videospot Online, Inc., and our owners, officers, directors, employees, contractors, affiliates, licensors, agents, moderators, guest experts, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, business opportunity, health outcome, or personal injury arising out of or related to your use of, or inability to use, the Site, products, services, memberships, community, or third-party offerings.

To the fullest extent permitted by law, our total liability for any claim related to the Site or any product or service shall not exceed the amount you paid to us for the specific product or service giving rise to the claim during the 12 months before the claim arose.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

22. Indemnification

You agree to defend, indemnify, and hold harmless BCWM, Videospot Online, Inc., and our owners, officers, directors, employees, contractors, affiliates, agents, licensors, moderators, guest experts, and representatives from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your User Content, your violation of these Terms, or your violation of any law or third-party rights.

23. Privacy

Your use of the Site is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

24. Termination

We may suspend, restrict, or terminate your access to the Site, your account, your membership, or any product or service at any time, with or without notice, if we believe you violated these Terms or if your continued access could expose us, the community, or others to harm or legal risk.

25. Governing Law and Venue

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Utah, and you consent to the jurisdiction of those courts.

25. Changes to These Terms

We may update these Terms from time to time by posting a revised version on the Site and updating the “Last Updated” date. Your continued use of the Site after any update means you accept the revised Terms.

26. Entire Agreement

These Terms, together with our Privacy Policy and any checkout terms, membership terms, or offer-specific terms presented at the point of purchase, constitute the entire agreement between you and us regarding the Site.
